- Fluid Recovery allowed in class action
(Gordon v Boden) where individual claimants could not prove damages.
Disgorge defendant profits, allow claims. Unclaimed money to charities.
- Illinois courts authority to certify
multi-state and national class actions (Gordon v Boden)
- Originated the New Securities Theory: Holders of stock who purchased prior to
period of federal stock fraud claims and cannot claim under the federal
statute may recover certain claims on other theories under certain
circumstances in state court actions (Mercury Financial: Dloogatch v
Brincat) a later statute limited class size but punitive damages are
available.
- Obtain Court Papers and Discovery sealed
by federal protective order allowed to be unsealed for use in other
class litigation (Grove Fresh v Everfresh the seventh circuit; Foltz v.
State Farm, seventh Circuit Court)
- Pension benefits increased by
modification of break in service rules from Teamsters Central States Pension Fund
for
value of $154 million (Sullivan v. Fitzsimmons) and Teamsters Local 705 for $11
million (Daniel vs. 705).
- Illinois Supreme Court (Decision
allowing attorney fee class action awards on a percentage basis).
- Recovered excess escrow refunds in nearly 35 Class Action mortgage
cases.
- Originated the claim attacking the use of substandard imitation
foreign parts instead of manufacturers crash metal parts in Illinois
state class action (Krusinsky v State Farm Insurance - $11 million
settlement).
- Price fixing in various industries: Antibiotics, Ampicillin, Fine
Paper, Folding Cartons, Corrugated Containers, Soap Pads, Plumbing
Fixtures, Commercial Insurance, Women's Clothing, Air Cargo, DRAM memory
chips and others.
